Game Upload and Publishing Terms

These terms and conditions define the legal agreement between the uploader (developer) and Fiuby Technology regarding the uploading and publishing of games on the Fiuby platform. Please read these terms carefully.

Purpose of the Service

Fiuby provides an independent platform for developers to upload, sell, and distribute their games to gamers. This service primarily focuses on indie developers and supports games up to 5GB in size.

Eligibility and Responsibility

Legal Compliance

If you are a developer under the age of 18, you must provide the banking details of your legal guardians (who are over 18) for receiving any earned income.

Rights, Ownership, and Legal Responsibility

The developer declares that the uploaded game is entirely their own creation and does not infringe upon the intellectual property rights of any other individual or organization. Uploading stolen, copied, or copyright-infringing games to Fiuby is strictly prohibited. In such cases, upon a valid complaint from the rights holder, the game will be removed. If a copyright lawsuit has been filed by a court, the relevant user's information may be disclosed to the competent local court upon official request.

Inappropriate Content

Although Fiuby values personal freedoms, due to its social media nature and age restriction of 13+, the platform prohibits the upload of games that:

• Promote terrorism or racism
• Contain content that humiliates or discriminates against any group
• Include pornographic elements or NSFW (Not Safe For Work) content

Any such content will be removed without prior warning. If necessary, the developer's account may be suspended, and user information may be shared with authorities upon legal request.

Game Size and Playability

Uploaded games must not exceed 5GB in size and must be in a playable condition.

Virus and Malware Prohibition

Games uploaded to Fiuby must not contain any malware or viruses. The developer bears full responsibility for this. Any detected malicious content will result in removal of the game from the platform. Fiuby reserves the right to take legal action against users who upload malicious software.

Revenue Sharing and Payment Terms

Revenue Distribution

Fiuby takes a 30-cent fee plus a 10% commission from each game sale. The remaining 90% of the net revenue is transferred to the developer. For low-priced products (e.g., $1–$2 items), the fixed 30-cent fee may result in a relatively high commission ratio per item. Fiuby plans to reduce this impact in the future through partnerships with payment service providers, especially for microtransactions.

Payment Procedures

Payments exceeding the 50 USD threshold are transferred to your bank account during the first 5 business days of each month. Payments are sent via bank transfer (IBAN/EFT) to the account provided by the user. If no banking information is provided, earnings will remain in the platform balance. If you enter your bank details after the 1st day of the month, any accumulated balance will be paid in the next payment cycle (the following month). Bank transfer fees are deducted from the payment amount and reflected accordingly.

Removal from Publication and Termination

By the Developer

Developers may request the removal of their game from publication. Such requests are processed within 7 business days. Even if a game is removed from publication, users who purchased it will retain permanent access to the latest version available in their library (except for products removed by Fiuby itself).

By Fiuby

Fiuby reserves the right to remove games from publication in the following cases:

• Copyright infringement claims
• Detection of viruses or malicious software
• User complaints

Termination

Fiuby reserves the right to suspend or terminate a developer's account due to suspected violations or legal obligations.

Legal Disputes

Any disputes arising between Fiuby and the developer shall be governed by the laws of the Republic of Estonia, and the competent jurisdiction shall be the courts of Estonia. By accepting these terms, the developer declares that uploading and publishing games on the Fiuby platform constitutes a legally binding agreement. Fiuby reserves the right to modify these terms at any time, and any changes will be communicated to developers accordingly.
